2 - Orders

The TEK Plongée website is an online store, but only a small selection of items is available for online purchase. For any information or order, please contact us via the information request form located at the bottom of the page or contact us by phone, mail, or email. An order becomes final only after confirmation and receipt of payment. The information provided by the buyer when placing an order through the website, by phone, or by mail solely binds the buyer. TEK PLONGÉE cannot be held responsible in case of error in the provided contact details, which would result in the inability to deliver the products. TEK PLONGÉE reserves the right to cancel any customer's order.

3 - Prices and Products

For metropolitan France and countries in the Eurozone, prices are indicated in Euros, including all taxes but excluding shipping costs. The prices indicated on the invoice are firm and those in effect on the date of the order.

The prices indicated include French VAT (20%). If one or more rates were to be changed, either increased or decreased during the season, these changes may be reflected in the prices of the items.

For countries outside the Eurozone and for overseas territories (DOM-TOM), prices are displayed excluding taxes (without the 20% VAT).

The products sold are new, unless specifically indicated. The items sold are described and presented with the utmost accuracy. If, despite all precautions, errors may have occurred, TEK Plongée cannot be held liable for such errors.

Please note that for customers located outside the European Union or using a secure VPN to change their IP address, the prices displayed are expressed without the 20% VAT. Customers located in overseas territories (Martinique, Guadeloupe, Réunion, Polynesia, New Caledonia, etc.) will see prices displayed without VAT. For these destinations, VAT will be applied at the time of ordering if the shipment is made to mainland France.

4 - Delivery Time, Conditions, and Return of Goods

Shipments are made either by Colissimo with tracking and signature or by DHL or can be picked up at our warehouses.

Shipments within metropolitan France are usually delivered within an average of 1 to 5 business days. The delivery time may be longer if the product is not in stock.

In accordance with the provisions of the distance selling Consumer Code (HAMON Law), you have a period of 14 days from the delivery of the equipment to return the ordered product for exchange or refund.

To do so, the product must be returned at your expense and with insurance, and it must be in its original packaging, intact, and accompanied by all accessories, user manual, and documentation.

4.1 - In case of requesting the return of a product

You must send us an email - via your customer account on our website if you created an account during your order - or a letter explaining the request for return with the reference of the order, addressed to:

4.2 - In the event of a product refund request

In the case of a refund, it will be processed within 14 days following the receipt of the package and after the inspection of the condition of all items by TEK Plongée company.

Used, incomplete, poorly packaged, damaged, or soiled returned products will not be accepted. Clearance, sale, or promotional items will not be accepted for return or exchange.

Any product return must be agreed upon in advance by TEK Plongée through mail, email, phone, or via your customer account on the website.

The transportation, packaging, and insurance costs for the "Outbound" delivery of the package (even if they were offered to you) will be deducted from the refund.

The shipping costs are stated on the final invoice included with the package, which may include a maximum commercial discount of 100% in the event that the product is not returned.

Please note that the downloadable invoice from the website is not a final invoice as it does not account for VAT and transportation fees.

The final invoice included with the package starts with the letters "FC," followed by the year, month, and a 5-digit number.

5 - Responsibilities

TEK Plongée cannot be held responsible for non-performance of the contract in the event of sudden stock rupture or product unavailability, force majeure, disruption or partial or total strikes, including postal services and means of transportation or communication, flooding, fire, heatwaves, etc.

The offered products comply with the current French legislation.

Prices, photos, product characteristics, and the accompanying texts illustrating the presented products are not contractual and may vary during the life of a product. Therefore, they are subject to modifications at any time without prior notice. This limitation originates directly from the manufacturers and suppliers who use these same terms for sales to us or our wholesale suppliers.

As a result, TEK Plongée cannot be held responsible for errors in any product images or descriptive texts.

In the case of defects in a product sold by TEK Plongée, TEK Plongée cannot be held responsible. The product is subject to the manufacturer's warranty conditions.

No loss of business, rental expenses for temporary replacement equipment, or any other type of ancillary service can be claimed from TEK Plongée.

Similarly, the "Outbound and Return" transportation costs for equipment are not mandatory and will be compensated at the discretion of TEK Plongée's customer service.

6 - Delivery

Delivery is made to the address provided during your order in the "delivery address" field, and you have the option to choose a different billing address.

The risks are transferred to the carrier from the date the ordered products leave our premises. Upon receipt of the order, the customer should inspect the goods and note any discrepancies on the delivery note if necessary.

Any claims must be sent by registered letter with acknowledgment of receipt within 3 business days following the delivery of the items to:

Deliveries within the European Union: All sold items are subject to a 20% VAT rate.

7 - Payment

Payment is made by bank transfer or by credit card (CIC Virtual TPE 3D Secure) at the time of placing the order. Checks are not accepted. The processing of the order for payment by bank transfer will be done upon receipt of the transfer in our account.

8 - Jurisdiction

In the event of a dispute, only the Commercial Court of Saint-Nazaire in Loire Atlantique (44) has jurisdiction, even in cases of summary proceedings, incidental demands, third-party claims, or multiple defendants.
